Legal Question in Wills and Trusts in Illinois

probate?

Our surviving parent just died, all assets (house, bank accts, stocks) were in her name plus us 3 children. We all agree on everything. Do we have to get a lawyer, since our names were on everything?

Re: probate?

You need to have an attorney review everything. You may not have to open a probate, but you may want to for liability purposes.

Sounds like you did not have an attorney review the situation ahead of time. Sometimes the conveyances are not done correctly.

Its usually cheaper to spend a little money upfront than a lot of money later
