What does probate mean?

If i have a will and there is nothing in it about my house being divided among my four children, will my house go to probate?

An estate that is valued at over $100,000 generally needs to be probated in Illinois, which means that your estate would be subject to a judge overseeing the distribution of your assets, and the payment of creditors, etc.

If your estate is worth less than this amount at the time of your death, you may be able to avoid probate. However, there can sometimes be benefits from having a probate proceeding for a small estate as well.
