Re: Probate wills

There is generally a six month timeframe in which the creditors of an estate are allowed to file their claims.

Although it is possible for the estate to make partial distributions to the beneficiaries prior to the end of the six months, many times no distributions are made until after that time. You should also be aware that there are many factors that could extend this period - such as contested claims, a will contest (brought by one or more beneficiaries), etc. Also a factor is whether or not there has been a probate estate opened, and whether it is a supervised or indepedent estate.

For an answer to your specific questions (taking into consideration all of the relevant facts of your situation), you should consult face to face with an attorney.
