Legal Question in Wills and Trusts in Illinois

Property and land trusts

I live with my 75 year old mother in her condo. The condo is currently in her name only. I also have a brother whom does not live with us. My mother says the condo is mine when she dies. My question is, what legal documentation do I need to ensure that when my mom passes, that her condo will be legally mine entirely. I don't want there to be any way that my brother might be able to claim any part of it or claim a portion of the money from the sale of it, nor any of my mom's possesions. She does not have a will. She has a ''land trust'' in which it says the condo will be left ''solely to'' me. I just worry that I might need more than that in the event my brother tries to take me to court over the condo or her possesions.

Re: Property and land trusts

Your post is confusing...first you say the condo is in "her name only" and later you say it's in a land trust. Either the land trust owns it or your mom owns it. From what you're describing it would be preferred that it's in the land trust and you're the sole beneficiary on the land trust.
