Legal Question in Wills and Trusts in Illinois

if someone puts the house in will and it states that it will be split up among 7 people for the price of the estate and eerything in it.house is paid off. how would that be handled does the government get the house in exchange for the money or does the family have to sell it?

The Will must be submitted to probate in the county where the person died. That Probate Court will appoint an Executor to carry out the provisions of the Will. Your other questions can be answered by an attorney who thoroughly reviews the Will.

Unfortunately, the government will not take your house and hand you the money. In order to divide up the funds you receive in exchange for the house, you will first have to sell the house. The probate court should be involved during this process. Once the house is sold, you will be able to split the funds in accordance with the will and through the probate process (in probate court).
