Legal Question in Wills and Trusts in Illinois
I received final receipt and disbursement and attorney and executor fees are one lump sum. How do i get a breakdown of fee if attorney states that records were not kept to make sure the fees are fair and reas0nable?
1 Answer from Attorneys
1. Ask the executor. If the executor refuses
2. Ask the attorney anyway. If both refuse,
3. You may be able to have the probate court intercede if this was summary or independent administration as the court is often not involved much in those kinds of estates, but if it was fully supervised by the court, then the court would most likely have ruled on whether the fees were reasonable.
Asking another attorney what a probate estate "should" cost would be virtually useless because the attorney would have to know a lot about the estate, but you may get an attorney to give you a "range" depending on what you know of the estate.
