Is there always a recorder at a hearing? We asked at the court house for the transcripts and the woman could not find any evidence that there was one. She said it was very unusual not to have one. We know there was a recorder at the hearing and believe the evidence was destroyed. Is this possible

What court and what kind of hearing? Not all hearings have a court reporter. A typical hearing for a decedent's probate estate will not have a court reporter.
Only some courts routinely have a court reporter. This information would be easy to find out and the court would be able to tell you who made the record. On the other hand, most times an attorney will order the court reporter and pay for it himself (or both parties agree to split the cost). Contact the other attorney and ask who the court reporter was. You should be able to order a copy directly from the reporter.
