Legal Question in Wills and Trusts in Illinois
Refuses to give access to house
My question is with regards to my father's house. My father died 3 months ago. The executor of my father's will is my first cousin and from what I hear, my brother is trustee of the trust. The will says that I will get a watch and the rest of his personal effects and household goods are to be divided equally between 4 siblings. He had three bank accounts but no mention of them in the will.As far as the house, the will states that he gives 'residue excluding any property to the Trustee acting of the written instrument under my father's trust. Also it states that he gave the executor 'the powers and discretion to distribute property in cash or in kin or partly in each, and to allot different kinds or disaproportionate shares of property or undivided interests in property among the distribute shares and also states that the executor can 'sell at public auction or private sale, to retain, to lease, to borrow money for that purpose to mortgage or to pledge all or part of the real or personal property of my estate'. I do not know what is in the trust. My brother will not give me a key to the house. How do I find out if I am a beneficiary? HELP!! No one is communicating with me. I AM CONFUSED! THANK YOU!

Under Illinois law you are entitled to an accounting of the inventory recieved by the estate and the proposed distribution, and you can have a hearing to object if you think it is not right according to the terms of the will, but you will need a lawyer to handle the technical requirements of the Objection to distribution and inventory
