Legal Question in Wills and Trusts in Illinois

Removing someone from the trust

I am 21, My father passed away 5 years ago leaving my brother and I with our mother. Our mom is an alcoholic and has a serious gambling problem, she has been convicted of DUI and has broken probation and been jailed for it 4 times. The three of us were left a trust, which my mom as trustee is using to support her bad habits. Is there any way we can get her out of it before she has spent it all?

Re: Removing someone from the trust

First, if you have a copy of the trust, read it and see what it provides in terms of removing a trustee and naming a successor. It may be that you will need to petition the court to have her removed. Contact a trusts attorney.
