Legal Question in Wills and Trusts in Illinois

Resale of cemetary plots

My parents own (2) plots in catholic cemetary. They decided to be cremated. They want to sell on internet but cemetary said no. They must be sold back to cemetary only. Cemetary will give what they paid back in 1970 ($968) but currently are worth thousands more. Cemetary advised plots are not to be bought in speculation but they will turn around and sell at a good deal of profit.(There is a waiting list) Please advise.

Re: Resale of cemetary plots

It seems like you need to take a look at the original purchase contract/deed for the cemetery plots. If you don't have a copy, the cemetery should be able to supply you with one.

In addition, you will want to obtain a copy of the cemetery by-laws. They usually dictate what restrictions apply to someone wanting to transfer a plot.

Good luck to you.
