Legal Question in Wills and Trusts in Illinois

My rights to dispute

My question is in reguards to my fathers life insyrance policy. He passed away in August 2005. The benificary to the insurance was instructed by my father to collect the claim and give equal amounts to me and my three siblings. She collected it and she refuses to comply with my fathers wishes because their aggreement was not in writing. I want to know if his children have the right to dispute this matter or can she get away with it.

Re: My rights to dispute

Hello. This beneficiary is now in control, unless you can show that your father was taken

advantage of. However, this will be an uphill

fight. You should retain a lawyer now, if you

have not already done so. Search to see if there

is a will that you don't know about. Don't assume there is not a will just because you have

not found one so far. Check drawers, cabinets,

safes, etc. to see if your dad made any written

notes about what his intentions were in regards

to this life insurance policy. I will be happy

to answer any additional questions that you might

have.
