Legal Question in Wills and Trusts in Illinois

signing of documents

If you have been given P.O.A, is it ever O.K. to sign the testators name to documents, or must you sign your own. Im speaking of documents that pertain to taxes, sell of property, banking, new car titles. And if it is not O.K, what kind of laws would pertain to this matter.

Re: signing of documents

The agent should sign, using his own name and then state "as attorney in fact for XXXXXX."

If someone has signed the principal's name rather than his own, there should at least be some indication made notifying everyone that it is not the agent's name/signature. Otherwise it might be considered a forgery.

Good luck to you.
