Legal Question in Wills and Trusts in Illinois
Single Sisters Estate
My sister died in Chicago 10/23/03. She was single and had a female room mate. We were informed by the room mate that my sister had made her (the room mates) Mother beneficiary to all her insurance. My sister had always said she was leaving everything to her 11 nieces and nephews, also my sister had borrowed money from both me and our brother within the last several years and had not repaid it. There are 3 siblings left and when the Drs. decided there was no hope for my sister to live (luekemia) we were called in and had to make the final decision on life support efforts. We also brought her home and made all the funeral arrangements.
My questions are: (1.) Is there anyway we can see the policies from the 2 hospitals she worked for over the last 30+ years? (2.) Can we file a claim on the estate for the money owed us? (3.) Do we as siblings have any rights?
I feel the signature needs to be compared because the room mate worked at the same location as my sister and had access to her files because she already knew who the beneficiary was before my sister died. Thank you.

Re: Single Sisters Estate
You need to contact an IL attorney who knows their law. I could only answer your questions based on someone who lived in AR. You didn't say if your sister had a will or not. That is the first question. The insurance policies go to whoever is the beneficiary, not through a will. At least, in AR, that is the way it would be. You could file a claim against the estate for the money you are owed, again if it were in AR. Whether you have any claim to the estate of your sister depends on whether she had a will or not. If not, then it depends on how IL determines the line of inheritance, meaning who are her heirs.
