Legal Question in Wills and Trusts in Illinois

sister is executor with mixed interest!

my dad did last week and my sister is executor. i found out that her and my other 2 siblings had interest only loans with my dad totaling 120,000. last year my dad had various credit cards that they were paying on, but took out an interest only equity loan tomake it simpler. when dad died they changed the locks. said a container was missing, said dad was shreading stuff lately. i said dad told me he wanted everyone to paybck loans. they all said my dad said verbally he was trying to get his lawyer who by the way is great frinds with my older brother who bld my dad of 150,000 morer throut his life. there is a no contest in my dads will or 1 doller. i get 30%, others 30%, 25%,15% to brother who got much throgh life. they started probate with that lawyer. but says he said i dont have to see any bills or statements. i want them to apay there share of this equity loan. 800 a month till sold. they say they dont have to. sister/executor is keeping me in dark saying dad could do what he wants. my dad did take out credit to help them but bank statements would show they were paying but she says she only has to show ledger of bills paid.I dont trust any of them. is getting a lawyer a risk of contest? me only get a doller? remove her as ex?

Re: sister is executor with mixed interest!

I'm sorry that you are going through this on top of the recent death of your father.

I would suggest that you seek the advice of a probate lawyer who can represent your interests in the probate court. Asserting your rights is NOT contesting the will. In addition, recovering assets to the estate (repayment of loans) benefits the overall estate so again, it is NOT contesting the will. Be sure that the lawyer you hire is experienced in probate matters.

Good luck to you.
