Legal Question in Wills and Trusts in Illinois

My sister was placed listed as Trustee for Revocable Living Trust for my mother and step-father's family trust. My step-father passed and 2 years later my mom passed. My sister said she owns everything and will not provide documentation to prove this. She has just sold my mother's home and said she would divide the amount among the four siblings, but is having legal papers drawn up for us to sign in order to receive our check. My step-father also had a bank account which my sister said he wanted her to have it and is keeping it all. Does she has the right to everything and how do we go about finding out what was listed in the family trust?

It sounds like you are indeed a beneficiary of the Trust and that she isn't disputing that. If so, then you are entitled to have a copy of the Trust to determine and protect your interest. Demand a copy of the trust.

It's hard to judge the bank account without more facts.

You might want to retain counsel to advise you as to your best course of action and to review anything that she asks you to sign.

If your sister won't provide a copy of the trust upon your request, the only way you can get it is to sue her for an accounting. How about the other two siblings? It seems you have the same issue, is there strength in numbers?
