Legal Question in Wills and Trusts in Illinois

My sister recently past away. She has no husband, will or eatate. I am her brother handling her affairs. She has a house which I would like to sell. The mortgate company wants a executor's letter or letter of assignment to talk to me about the property. Where can I get these documents?

To sell your sister's house, you will either need a Court proceeding that allows you to act on behalf of your Estate, or a certain type of title commitment policy. I strongly suggest that you talk to an attorney about which is more appropriate. Feel free to call me for a free consultation.

My condolences on the loss of your sister.

I think you need to work with an attorney in moving forward. What you need to do, what you want to do and what other parties (such as the mortgagee bank) are prepared to do is somewhat fluid depending on the facts of your situation, as is the timeframe in which action needs to be taken. Please feel free to contact me to discuss your situation in greater detail.
