Legal Question in Wills and Trusts in Illinois
I have a small estate affidavit for my mother. An estate check was issued.
How do I cash it? From what I’ve read I shouldn’t have to go through probate

If the check was issued to the estate then you have either filled out the small estate affidavit incorrectly or the bank made a mistake. I highly recommend speaking with a probate attorney such as myself before proceeding since the small estate affidavit confers personal liability on the debts of your mother (if any). Best of luck.
