sole heir

My daughter is sole heir of her fathers estate. No will. No other living children. I am not a widow. My daughter is 11. Mother of deceased is supervised administrator. Estate sale is over took place in june 1 yr ago. The property was sold June 29 2007. Per motion to court for sale. I was told by attorney for administrator that there is no money left and my daughter will only get less than 15k. the house was sold for 179k. That the bills totaled 6 figures and thats all left for the estate sale. Who do I go to if I want a written copy of all this information. I asked to court this question and the judge asked it be put in the order. I have not received any money for my daughter from the administrator or her attorney or a written accounting of the estate sale or sale of the house. I thought this would be cut and dry. I just want to setup a college fund for my daughter. which is what her father and I talked about. Why is this process becoming so difficult. Does my daughter need her own attorney?

Your daughter (or you on her behalf) is entitled to a written detailed accounting from the administrator covering all of the estate assets and all debts and expenses that were paid. I would make a written demand of the administrator and attorney. Check what the court order requires. If they fail, then you may want to motion up in court to demand an accounting. Only then can you determine whether what they're saying is legit.

It would probably benefit using an attorney, but whether the cost would be worthwhile is harder to say.
