Legal Question in Wills and Trusts in Illinois

If a spouse is going to die does it make sense to have their named removed as a trustee before they die to make it easier for the surviving spouse or does it not matter?

It should not matter if everything has been implemented properly, however to give a proper answer an attorney would need to review the trust and the entire situation.

Usually, people select their first choice as a Trustee, and then list successor Trustees who would be appointed to act if their first choice is unwilling or unable to do so. If you know that a first choice will probably not be available, it could be a helpful time to review the Trust with a professional. Feel free to contact the attorney that prepared the Trust.
