Re: Springing P.O.A

Uncle had a P.O.A drafted in 1994, and also signed in 1994 that stated a Doctor's letter needed to be attached to become effective. My question, If the agent knew they were going to be given this power back in 1994, and in 1998 before they had it put in effect, took steps to have assets redirected did they do anything wrong.

They were criminally wrong if they re-directed assets BEFORE the POA became effective. You should hire an attorney immediately.

depend on exactly what they did, but it seems the POA was not in effect at the time so the transfer was improper
