Legal Question in Wills and Trusts in Illinois

Stealing Money out of Will

My grandfather died and left me with $3000 of inheritence. before i recieved the money, i gave my dad permission to take out $485 for money i owed my stepmother. But he also took $650 WITHOUT my permission for money he has told me and several others that i did not owe him for. Is that legal? I want to know what my rights are, and if i need to take action against him, what can i do? thank you.

Re: Stealing Money out of Will

Whether you have an action against your father depends on the will and the status of the estate. If the will says that you were to inherit $3,000, then you should receive that amount of money, unless there was not enough money in the estate to cover the expenses that should have been paid prior to distributing the money to the beneficiaries.

Is it possible that your father took $650 to pay the expenses of the estate?

If the answer is no, and you determine that you were entitled to the money, then you can file an action against your father in your local municipal (or small claim's) court.

Most courts have a "pro se" section where you can represent yourself without a lawyer (thus saving you the cost).

Good luck to you.
