Legal Question in Wills and Trusts in Illinois
My stepfather passed recently and there is 8 kids all together in his will.His present wife has control of everything until she dies or remarries. 3 kids are by his first wife which he divorced yrs. ago,he married my mother and was married to her for 30 yrs. til she passed in 96 and there where3 of us when they married, he sold 2 properties that him and my mother had together after she passed,then he married his third wife who has 2 kids.all children are well over legal age,they had no children together. Now she is having an auction to get rid of everything and moving to Oregon.My guestion is can we ask for a settlement now and sign off of the will? I know we are all in this will but know once she goes to Oregon that will be the end of everything and Some of us feel thats not right especially since he was married to our mother the longest of all 3 wife.We didnt get anything when she passed. Can we reguest a settlement and sign off the will ?

It is very difficult to tell what rights you might have without looking at the will and seeing how all of the assets are owned. If she owns the assets then you may have no right to them regardless of what the will says.
