Legal Question in Wills and Trusts in Illinois

Title

My brother has passed and I have a vehicle that is in his name. I sent the death certificate in to get the title transferred into my name however they wouldn't allow me to. I am making payments on the vehicle still, would I have to refinance the car in order to get the title transferred or is there anything else that could be done? The purpose is to sale the vehicle, there is no executor etc.

If the vehicle is in his name then it passes through his estate. If he has no Will, then it passes by state intestacy laws to his legal heir(s). If this is the only asset (and no debts), you should be able to use a small estate affidavit to get the title into the names of his heirs.
