Legal Question in Wills and Trusts in Illinois

transfer of property

I am about to become age 60. I was divoreced in 1999. In 2002 I got a quitclaim deed with a life estate to me and the remainder vesting to my son & daughter as tenants in common. Does this protect my property in case I go to a nursing home and does it prevent going to probate court? Is there a better way to do this and should I have a will and or trust fund. The house is woth about $60,000 and I have a 2005 toyota .that is all I own. No other debts.

Re: transfer of property

A life estate with a remainder to another person would seemingly protect your property from both nursing home claims and probate. However, you should have an attorney review the actual deed to be sure that it does what you believe it is supposed to do.

Good luck to you.
