Legal Question in Wills and Trusts in Illinois

What is a Trust and Who Makes Sure it's handled properly?

What is a trust? After a death, is any official entity responsible for ensuring that the terms of the trust are carried out properly and assets distributed as the trust sets forth? I just found out my father's home is in a trust (my mother is deceased), and my brother and sister are sneaky and dishonest, so who or what will keep them in line?

A trust is a legal entity which holds property through a trustee for the benefit of another on terms to protect that other person, a beneficiary. On death, the trust is usually not administered by the court. A beneficiarry can sue the trustee for court intervention.

If you are a beneficiary, you can sue in court for intervention and to insist on an accounting. We can help you with this. Contact us at 847 249 9100.
