Trustee's Responsibility

My Mother passed 2 months ago. My Sister is the Trustee of my Mothers house. What does that mean, and what does she have to do at this point? Is she able to live in the house, and if so, what is her legal responsibility. Note, upon the sell of the house, money is owed to the city for work they did on the house (The City of Maywood will repair your home and you do not pay until the home is sold). With my Mother passing and my sister potentially living there, will the city have to be paid? Lastly, how can we find out if the attorney filed the Will and Trust papers (we are unable to locate the attorney)?

Your sister's responsibilities as trustee are detailed by the specific terms of the trust. Every trust is structured differently. Assuming you're a beneficiary, you should request a copy of the trust instrument from her if you don't already have it. It is not filed anywhere. However, if there is a Will it is supposed to be filed with the clerk of the court in the county where your moth lived. You might want to consult a trusts attorney to review the trust as to your rights under the trust and your sister's responsibilities.
