Legal Question in Wills and Trusts in Illinois

waiver of notice

i just found out i am a beneficiary in a will. I received a letter from a lawyer asking me to sign a waiver of notice. Is this normal to sign? I have no reason to protest this.

Re: waiver of notice

It depends what the waiver is for - the letter should include more details about what you are waiving. It is probably waiving objections to opening the estate, but call the lawyer and ask before sending the waiver back in.

Re: waiver of notice

Yes this is normal to sign. It makes administration faster. You should ask for a copy of the will and an inventory of the estate.

Re: waiver of notice

The waiver of notice is likely for the opening of the probate estate. However, if the letter is unclear, give the lawyer a call and ask him to explain what you are being asked to sign.

If it is indeed a waiver to open the estate, it is a routine form.

Good luck to you.

Re: waiver of notice

Do NOT sign anything without an attorney if you are a Benificiary. You need to know what your benefits are.
