Legal Question in Wills and Trusts in Illinois

what to do when there's no will?

my grandmother recently passed without a will. she had a paper which said that she wanted her oldest daughter to have her property and possessions if she died. it also asked for her daughter to take care of her grandson, whom she'd raised since birth. she had me buy Willpower, few years ago to put her wished in Will form, but i never found the time, or just kept putting it off. I really regret it. anyway, now that she's passed, most of her siblings expect her to take the house, my question is this. if none of her siblings protest her having the house, what steps need to be taken so that she can have it legally put into her name?

She must file a probate in the Circuit Court of Cook County, Probate Division. What you have is a will of sorts. It may minimally meet the standards of a will. However, the only way the title of the house will be passed is by order of court. Please call for a free consultation.

All of the siblings could quitclaim their interest to the sister. Then you would file a probate to move the property.
