husband died no will property in both our names, can son sue for property

If your property was held in joint tenancy with your husband, then it would become your sole property upon his death.

However, if the property was held in a manner other than joint tenancy (such as tenancy in common), then your son may have an interest in the property.

To be sure, have a lawyer review the deed to the property (if real estate), and the titling of other personal property to be sure of yours and your son's interests.
