Legal Question in Wills and Trusts in Illinois

No Will -- Do we need to go to probate?

My father passed away without a will. The house and bank accounts are held jointly. The house itself is worth over $100,000. The children all agree that everything should go to mom. What do I need to do to help mom take care of everything?

Yes, you need to go to probate - in Illinois that is not the scary, expensive proposition people have been led to believe it is. Also, if you go to probate the time for creditors to make claims against the estate is much shorter.

If you are in Rock Island County the county clerk will be able to tell you what steps are necessary to properly file: http://www.co.rock-island.il.us/CirClk.aspx?id=278#pb
