Legal Question in Wills and Trusts in Illinois

Will

This question refers to the law(s) within the

State of Illinois, County of Cook;

A relative left a will directing that all proceeds

be equally divided between heirs. One heir (son of

deceased) has never been located in over (10) TEN YEARS!

The Probate Lawyer refuses to release this heirs

portion of the estate to the (other) surviving heirs.

Is there any way that the (other) surviving heirs

can have the ''missing''/presumed dead heir declared

dead to receive the remainder of the estate? The

estate is being held by ''some probate division'' of

Cook County in the State of Illinois!?!

There must be a search made for known and unknown heirs to an estate; however, 10 years certainly seems an excessive amount of time to keep an estate open without distributing.

Has this estate in probate court all of this time?
