Legal Question in Wills and Trusts in Illinois

No Will

Remarried, X is also. Have will from 1st. marriage, none for present. Home is in my name only. ? Will my present husband get the home in the event of my death? what about grown children? Do I need a will to insure husband keeps home? Home is not paid for. Is will from first marriage still legal?

Your previous will is still effective *except* that the bequest to your husband has been revoked by divorce. Depending on the wording either everything goes to your kids [more likely] or you're intestate.

Your present husband receives nothing.

I suggest you need a new will. A new marriage is a good time to review your situation.
