Legal Question in Wills and Trusts in Illinois

Wills and Deeds

1. Does a deed override a will?

2. If there are 3 people on a deed and two people want someone off of the deed is there anyway to get them off, if they made a mistake by adding them or can they somehow sell the land?

Re: Wills and Deeds

When a person dies, his interest in real estate may pass by will, or it may pass directly to another person(s) on the deed, if the property was held jointly.

You need to have an attorney look at the deed (and the will) so you can be assured of a proper answer to your question.

Good luck to you.
