Legal Question in Wills and Trusts in Illinois
Wills Trust and Estates
Are my sister and I allowed to spend time in the residence, we were willed and was also foreclosed on due to reverse mortgage, possibly to get a key from the admin who is local and remove the property within a time frame, as in 2 days. We are traveliing from another state. We are the ONLY 2 heirs of the property and contents. So No one has to worry about us taking anything that does not belong to us. All of the property is ours we will be together packing up the things (that are LEFT from a step niece who has been carrying property out and selling it, since the day step mother passed and still retained a key and been in and out of the house that should have remained secured upon the death and who is not the admin) before foreclosure of which the lawyer sat on the letter for 2 months leaving us very short on the remaining time before foreclosure which is April 15th. We will hire a lawyer when we arrive in town. Also was a certified letter from the admin to the attorney relieving him acceptable or does that have to been done in court. He has given her NO guidance. There is plenty of estate money for payment so that would not be an issue. Thank you for your help

Re: Wills Trust and Estates
I believe I answered your posting before.
You should look into hiring a local attorney to assist you in asserting your rights to the personal property.
If there is a probate estate opened, you have standing to appear in court to assert your rights. If there is not one currently opened, an attorney can advise you on what steps to take.
Good luck to you. Let me know if I can assist.
