Legal Question in Wills and Trusts in Illinois

Wills and Trusts

My Grand Parents have now both passed away. I am one of three grandchilren. My mother is an only child and very selfish. My Grand Mother had asked that I get the safe out of her closet before her daughter got to it but to no avail she got to it before I did. I have no idea what the contents of the wills or trusts contain and what I and my siblings may be entitled to. What should I do?

Re: Wills and Trusts

If there was a will, the person in control of it is required by law to file it with the County Clerk (Probate) within 30 days of the date of death.

Check with the clerk's office to see if the will has been filed. If not, and you know that there was a will in existence, make inquiries to your mother or your grandmother's attorney about its whereabouts.

If there was no will, the estate will pass by the intestate laws of the state of Illinois.

I would advise you to have an attorney review the situation to determine what rights you might have.

Good luck to you.
