After 3 surgeries still no benefits from workers compensation
3 Surgeries , permanent injuries to my arms, Company laid me off, Not able to do my job anymore. Company never compensated me with benefits until now. Company does acknowledge it is work elated. Do I have a say in negotiating the settlement? Can an attorney settle without my consent?

You most certainly have a say in the negotiations and it would be malpractice for an attorney to settle without your consent. You may also have a retalitory discharge claim. If you currently have restrictions, you may also have an on-going right to workers' compensation benefits. I would not settle without speaking to an attorney first. The simple answer to your question is "Yes." Any lawyer that may represent you must honor your desires in negotiating a settlement. However, you may not want to settle your case as there are benefits that are available to you if you do not settle your case and proceed to trial. Whether you should pursue settlement or prepare for trial is a question that can only be answered by consulting with a lawyer in the first place.
