Legal Question in Workers Comp in Illinois

Approved but no check yet

I was injured at work and diagnosed with tendonitis, carpal tunnel, and cubital tunnel and may have to have surgery soon if condition doesn't improve. I have been off work for over a month now, and still have not received any payment from the work comp insurance company. I have called multiple times and each time I get a different person who assures me that the payment will be sent out that day....then when nothing shows up, I call back and get another person who assures me the payment will go out then. This has been going on for the past 2 weeks nearly every other day. I cannot get the actual claims rep to answer her phone or call me back, dispite repeated messages that I have left her requesting a call back. My question is, what are my options here? I was under the impression that they had 14 days to make payment, but we are now over 30 days into this and still nothing. I have not contacted an attorney since they are not disputing my injury, and I figured seeking legal councel would just cause them to tie things up in the system even longer. But, I still have bills coming in regardless of being hurt and a month without pay is taking it's toll. So, I would appreciate any advice on how I can get them to pay my benefits. Thanks

Insurance companies earn interest on money in their accounts. Thus it is in their best interests to hold onto their money as long as possible. Unfortunately, without an attorney, there is no good way an employee such as you can force the insurance company to pay. If they have no basis to deny your claim, the employer should be paying and the only way to ensure they continue to do so, is to hire an attorney who can file appropriate motions in court to ensure payment. An attorney can even seek penalities if the employer's failure to pay is unreasonable or vexatious.
