Legal Question in Workers Comp in Illinois
Cart Pusher at WalMart Experiences Chest Pains & Is Rushed to hospital
While working as a cart pusher at WalMart, I began feeling faint, had shortness of breath, and pains in my chest and up my arms.
I was 21, trim build, no history of heart problems or health issues. Does this qualify for workman's comp or does my employer have any legal or financial responsibility?

QUESTION: While working as a cart pusher at WalMart, I began feeling faint, had shortness of breath, and pains in my chest and up my arms. ANSWER: It really depends a great deal upon the diagnosis of the problem.
If you suffered a heat stroke because of the temperature and the radiant heat of the blacktop parking lot and you went to the emergency room - I would submit that it was a work related accident and you should have your emergency room bill paid. However, your case would most likely end there.
If you suffered an idiopathic injury, heart attack or mild stroke - I would submit that you would have a very difficult time proving that your accident arose out of work.
Please provide a few more details about your present condition and the findings of the doctors.
Thanks,
Matt Belcher

It might be if your doctor thinks it caused, aggravated or accelerated your heart condition. If you would like us to analyze this for you further please contact us.
