Legal Question in Workers Comp in Illinois

class action suite

Your probably tired of some of my questions but I find this site so informative. My employer is self insured and also a municipality (very large). There are several people over the years here that have been for lack of a better termed screwed by the same Comp claims adjuster. I along with a few a my fellow employees were wondering is there anything we can do to get them to lose their self insured status or anything we can do to go after the adjuster them self. It doesn't seam fair that you can have a renegade person in a position making medical evaluations with no medical training. Yes we all have cases pending, this is my third time going back to the commission for missed TTD I have won every time their forced to pay with penalties then a few weeks later they try do do it again. I got to the point were I flat out ran out of money and had to return to work or face losing my house. Besides high rate advances on settlement I didn't have much choice but to return to work against my doctors wishes and fight while I am getting paid.

You don't mention having an attorney working for you. Usually, those who think they want to save a couple of bucks by going at it alone and not hire an attorney end up getting screwed.

There is nothing you can do to make your employer lose their self insured status--as if they were insured by an insurance company would make any difference.

The adjuster is not a renegade. Most insurance companies and self insurer underwriters, pay a bonus to their adjuster for every dollar they can save the company--that is for every dollar they short change you.

So if you guys think you can go against these people by yourself and without the help of an attorney, I have a bridge in Brooklyn to sell you.. I'll give you a very good price! It's an antic!

Good luck-

I can't answer your question as you do not identify the municipality and make a lot of assumptions which may or may not be true. You indicate you have a lawyer. He/she should be able to answer your question. If not, I would be happy to examine some of your facts and render an opinion if you care to call me.
