Legal Question in Workers Comp in Illinois

Coal Mine Death of Father 1959

on Nov 3, 1959 my father was killed while at work at the Peabody Coal Company. I did not learn until recently that my Mother recieved little compensations from the coal company due to the fact my Grandfather refused to allow her to sue for compensation, it is my understanding Grandfather was a company man and did not believe in such a lawsuit. Is it too late for my Mother and sisters to recieve any compensation from this loss?

Re: Coal Mine Death of Father 1959

The Statute of Limitations in Illinois is three years. So any accident whether resulting in injury or death that occurred in 1959 could not be filed now. If fact, the Stature of Limitations in 1959 was only two years.
