Legal Question in Workers Comp in Illinois

Am I still covered?

I was hurt on the job in Aug. 2000. Went to hospital. Workman's comp claim was filed. Dr. wanted me to have therapy, but not until the swelling was completely gone. I was released from my position 3 days before I was to go to therapy. Am I still covered under the same workman's comp claim as when the injury occurred?

Re: Am I still covered?

The simple answer to your question is "YES" you are still covered. You said that you have filed a WC claim. Does that mean that you have a lawyer? If so, you should ask you question of him/her. But you may be referring to only having filed an accident report with your employer. That is not the filing a claim. You have three years from the date of accident within which to file a WC claim/case or two years from the last payment of compensation (TTD or medical expenses). But you may run into some other problems. If your doctor has delayed in getting physical therapy started, the insurance company could stop all medical treatment. That does not mean that you lose your claim. It only means that they don't agree with you. That is what a case is all about. That is why you should hire a lawyer and make sure that you have a case on file. Joseph Spingla (www.compjoe.com) (1-877-CompJoe)
