Legal Question in Workers Comp in Illinois
Do you have a right to cross examination of proofs
IF A PICE OF EVIDENCE IS OFFERED AT THE END OF TRIAL AS PROOFS. DO I HAVE THE RIGHT TO CROSS EXAMIN THE PROOFS?
IF THE PROOF WAS OBJECTED TO AT THE TIME OF TRIAL, FOR NOT BEING A CETIFIED COPY, AND NOT AN ORIGANAL DOCUMENT. BUT AT A LATER POINT THE OBJECTION, WITH DRAWN BASED ON OPPOSEING ATTORNEY REPRESENTING IT AS A FAIR COPY,AND ACCERATE COPY DOES THE PRIOR OBJECTION STAND?
and last later when i looked at this pice of evidence, i found that on the date it said it had the largest percipatation was on the 31 st. when in fact it was on the 19th in fact not true it it,s self showed it was another date. on the same pice of evidence. how do i approch this ?

Re: Do you have a right to cross examination of proofs
I'm not sure I entirely understand your question. It sounds like you are handling a Work Comp claim by yourself. It sounds like you are referring to a weather report that was introduced into evidence. You don't say if you won the case or lost it. Weather reports are to be certified to go into evidence on a jury trial without benefit of cross examination. On a Work Comp claim they would be taken whether certified or not if they show all of the relevant dates. If that weather report shows the weather on the two dates you mentioned, you can always point out the 19th when you feel there is something that helps you.
