Legal Question in Workers Comp in Illinois
Fall @ Work
I was leaving work and fell down a flight of stairs on company property. I ended up with a severe concussion and was out of work for two months. I was required to fill out a accident report and received 66 2/3% of my pay while out and now I have about $2500 worth of medical bills that insurance didn't cover.
Would this be work comp or not? I was not carrying work home but just was done with work for the day and went out one of the two entrances that was available in our building and one I used quite frequently.

Re: Fall @ Work
I will try to provide a more complete answer. Generally, worker's compensation covers accidents which occur while you are working. An enormous amount of case law covers situations just as yours.
You had a worker's compensation covered accident if there is something particular about the stairs that would expose you to a risk that is greater than the general public.
Also if you did NOT have a covered accident they would not have paid you while you were off of work.
Therefore, they should also pay that medical bill and provide you with some award for your injury.
Good Luck!
