Is there some way to figure out an amount to ask for in a lawsuit?

If a person was injured on the job and informed by the doctor's that they would not release her to go back to work; she then filed a workmans comp claim. She was then fired when she couldn't return and the agency recieved word that she had filed a workman's comp claim. She has been battling with the company for seven years and has not been able to work or been paid any money. She was raising teenagers at the time who were in school and had needs. She tried to find employment so she could make ends meet, but she could not and cannot get a job due to the doctor restrictions. She can only work 4 hours a day, needs to sit and stand as needed, and needs at least two breaks. She had back surgery once that didn't take and cannot afford another one due to the lack of funds. She has attended numerous doctors and has plenty of doctor bills due to the injury and case alone. She is and never has been able to recieve any disablity. She has just recieved word that the case is going to go to trial and they want to know how much she is asking for. She is not sure how much is a ligitament amout for all that she has been through. She has not been paid in the seven years she has been unemployed.

We would propose reviewing your complete medical records, and would take into account your wage rate in determining what an appropriate monetary amount would be.

The short answer to your question is "Yes." But there is no one answer. In order to figure out what any case is worth requires a review of medical records, limitations placed on work activities by doctors or therapists, and the age, and education level of the patient/client. Much of this evaluation done by attorneys results from years of experience. You would be best to consult an attorney who is experienced in your area. Good Luck.
