Legal Question in Workers Comp in Illinois

Hernia Problems

2 years ago, I had inguinal hernia repair because of a work related accident. I was on work comp at that time. I started having pain and have been to various diff drs. I was told it is an left inguinal nerve entrapment due to the surgery. What I want to know is, if the drs. have to kill the nerve, which has a possibility of effecting my sexual health, should I get a lawyer?

I think you know the answer already - YES.

FYI, Hernias are NOT very large workers' compensation cases - they usually have a lower permanency than even a back strain/sprain.

However, complications are generally compensable as they arise "out of" the original accident.

The complications you describe sound serious but not they are not very likely, honestly.

Whenever you have any surgery, including hernia surgery, the complications on the release "form" are everything including dismemberment and death.

Because site of the operation is located near your sexual organs, the release will say that there are complications including "sexual side effects such as impotence, sterility," etc.

The actual likelihood of the side effects in your case would remain low with a well qualified surgeon.

I would highly recommend that you do seek a lawyer and file a claim. Any problems you are now having, including additional treatment for nerve intrapment, and the loss of function of your sexual organ, would be related to the original work injury, and thus, compensable.

Even the hernia surgery itself would entitle you to a settlement for some permanency. But, given the new findings, you have a serious situation and it would be worth while for you to proceed, if not to ensure you are paid WC while your off work after your upcoming treatments.
