Legal Question in Workers Comp in Illinois

Illinois Provider Indiana Carrier

I am an Illinois provider of serivce, the patient was an Indiana employee. The patient had an accident in Illinois. We are not contracted with the employer's Workers' Compensation carrier and under Il WC Statues we can balance bill the patient. The WC carrier disagrees because the patient works for an Indiana company and is applying Indiana WC Statues. Who is right?

This sounds like an Indiana accident to me. If so, the rights of your patient are governed by the Work Comp act in the State of Indiana. Their laws are different than Illinois'. You will not see an Illinois company getting into this case.
