Legal Question in Workers Comp in Illinois

What next

I was injured in June 02. Injury was torn THHC in wrist. I have been seeing a doctor since July 02 for injury. He had me in a brace from July to Jan 03. Gave me two cortizone shots, which didn't help and finally in Jan 03 I had surgery. After surgery I was off for 6 wks and started physical therapy. Pain has decreased but is not completely gone as the doctor said it would be. I see him this week and he is expecting to release me and for us to part ways. Work Comp company has been very good to me and when I told my representative I was still having pain she asked if I was going to go back to my second opinion. I told her I didn't know. I don't know where to go next. I was paid temp. dis. benefits while off and they have covered everything for me. Should I get an attorney. I have been told by outside source I am entitled to pain and suffering. What should I do? I am not out for a lawsuit and not even looking for a settlement. I just want my wrist fixed or to be told that is the best they can do and then go from there. Any ideas?

Should you get an attorney? Of course you should. Any time you feel that something is not right, well, chances are that something is not right. If you need to get a second opinion or you need more medical treatment, all that, you need to explore and an attorney is the one to help you navigate through all this.

The Workers Comp benefits you have received already are "Benefits of your Employment." There are further benefits to which you are entitled. Whether you pursue those benefits, or not, is totally up to you. You do have rights to a second opinion from another doctor. If you sincerely believe there is some further medical treatment to pursue, you should definitely have another doctor examine you. However, you should make sure you go to the RIGHT doctor. Do not let the Work Comp company choose the doctor for you. This is a decision that a lawyer helps you to make. Also, any settlement of your case is NOT for "pain and suffering." That is not what Workers Comp is about. Again, any settlement needs an experienced attorney who knows how to evaluate a claim properly. But, it appears you are not in a position to even think about settlement yet. The Workers Comp insurance company is; but you are not. I hope that is of help to you.
