Legal Question in Workers Comp in Illinois

Injury Trial

My husband received multiple injuries after falling down an elevator shaft at work. His injuries have changed our whole family's life including our five children. He sustained Traumatic Brain Injury, Frontal Lobe Damage, Short Term Memory loss and Post Cncussion Syndrome. Also Brain Stem and Sinal Cord injury nine bulging disks left Ulner Nerve damage, Spastic Colon, Back spasms and nerve

damage to lower body. Loss of pain and some sensations from the chest down and almost total Autonomic Dysfunction extremely low blood pressure and improper temperature regulation and balance problems occasionally. And the most

traumatic mental part for my husband is having Penile Dysfunction and bowl inconstancy and the time this is taking after being told he has fifteen to twenty years

of life. Workers Comp. motioned as if they wanted to settle back in December but nothing ever came of it. Now we have a Trial date at the end of April and I am worried that my husband is going to become very angry at the Trial. What should we expect to go through during the Trial and is there any light at the end of the road for us.

Alright, I never use this forum to lecture, but WHY DON'T YOU HAVE AN ATTORNEY?!

This case is your family's only chance to recover for your husband's injuries, and even under the maximum the system will allow, it will be woefully inadequate. I see where you already have two very proper answers to your question. I will add another. First, I ASSUME that you have an attorney for the trial you say is about to occur. If you do, then you should ask your question of him/her. If you can't ask that question of your present attorney then maybe you need another attorney. If you have no attorney for "this trial," you are in definite need of one. If you are proceding at the request of some insurance company who says they are "giving you something," then you will probably discover your loss later. Even if they are being fair with you, you have no way of knowing without legal representation. If you are trying to save on attorney's fees or some insurance tells you "the lawyer's just take their cut" then you are naive and will stand to lose when you think you are getting something. There is another thing, too. You don't mention a personal injury case in addition to the Work Comp claim. Have you considered this?
