Legal Question in Workers Comp in Illinois

laid off after returning to work continued

to further elaborate. The warehouse consists of 3-4 individuals currently, all minorities..--name removed--is not in a union and we do have a current claim going with workmans compensation.. We do have a lawyer who says there is nothing we can do in this instance, but it seems unethical what is happening. Especially if he is laid off, we are not even sure if he can collect unemployment, since they calcuolate wages from the period of 1/1/01-12/31/01. During this timeframe he only worked two months. What statue within workmans compensation might apply? thanks
