Legal Question in Workers Comp in Illinois
Too late to sue?
In 1989, 15 yr. old daughter was injured at work--company offered $2000 out-of-court settlement--I refused & never sued company. Daughter is now 33--injury is causing complications (rashing, blisters, burning) can daughter now sue for herself or is the entire case too old to re-open?

Re: Too late to sue?
It depends how the injury was sustained. In Illinois, a person typically has 3 years in which to bring a claim for damages arising from work activities. However, an employee has 25 Years from the last day of employment in an environment of hazardous radiological activity or asbestos to apply for compensation for injury cause by exposure to radiation.
The lesson to be learned is this: Get the advise of an attorney when the injury occurs. Don't naively believe you can handle everything yourself without competent counsel.
